Introduction

As chief legal officers of the states and commonwealths, attorneys general are the last line of defense against an increasingly overreaching federal government. Attorneys general have a duty to uphold the laws of their respective states and uphold the U.S. and state constitutions.

One of the ways in which attorneys general protect the integrity of state laws and constitutions is by carefully reviewing the actions of the federal government and responding when they break the law or overstep the bounds of the Constitution.

Federalism is the division of authority between the federal and state governments that the Founding Fathers created to provide a check on federal power so that the federal government would not become destructive of the very liberty it was instituted to protect.

While some naïvely argue that the Constitution should “evolve” due to the fact that our Founders could not have foreseen the issues faced by our country today, they forget that the Founders faced tyranny firsthand and understood it well. This led to the creation of a Constitution that relies on limited government, precisely to protect our citizens from today’s unprecedented overstepping of the “division of authority.”

The Landscape

While each Attorney General has policy disagreements with the Obama Administration, those disagreements are not what serve as the basis for this effort. For example, this Administration makes many decisions and takes numerous actions that Republican attorneys general find politically ignorant or flawed from a policy standpoint. However, that does not make those decisions or actions illegal. The purpose of this report is to outline actions taken by this Administration that are violations of law.

In this book, her most recent, Marcia Angell explores pharmaceutical research, deplores the rapidly expanding involvement (and distortion of truth) of Big Pharma, and implores us all (physicians, patients, politicians) to do something about it. Since leaving the Journal, she's gone behind the curtains of Big Pharma, Big University, and Big Faculty. Drawing on her own work and on her thoughtful analysis of research, company financial statements, and investigative reports into drug development and marketing, Angell writes with the unambiguous and unyielding style that Journal readers came to expect and trust.

The current slide toward the commercialization and corruption of clinical research coincided with the election of President Ronald Reagan in 1980 and the passage of the Bayh-Dole Act, a new set of laws that permitted and encouraged universities and small businesses to patent discoveries from research sponsored by the National Institutes of Health (NIH). Research paid for by the public to serve the public instantly became a private, and salable good – one that is producing drug sales of more than $200 billion a year.

Commercialization had both specific and broad effects. Readers of this journal and others are familiar with investigations into the control that research sponsors at pharmaceutical companies exert on the design and analysis of clinical trials (including the distortion of primary outcome measures in trials) and the issue of reporting, nonreporting, and biased reporting of results.

Angell reminds us of the increasingly cozy relationships between big industry and the faculties of universities.Not only are narcissistic donors renaming the medical schools; they are buying access to the best minds of their faculties. Angell's examples of the large consulting fees paid by industry to individual faculty members and to NIH scientists and directors are astounding.

The broader effects are felt in the commercialization of universities, medical faculties, and our profession. In 2000, in a letter written in response to Angell's Journal editorial, "Is Academic Medicine for Sale?" a reader supplied the answer: "No. The current owner is very happy with it." The increasing intrusion of industry into medical education and the almost complete domination of continuing medical education (especially regarding drugs) by the marketing departments of large pharmaceutical companies are a scandal.

The same companies also spend heavily to lobby governments. According to Angell, Pharmaceutical Research and Manufacturers of America, the pharmaceutical industry's U.S. trade association has "the largest lobby in Washington," which in 2002 employed 675 lobbyists (including 26 former members of Congress) at a cost of more than $91 million. The result has been above-average growth in corporate profits during both Republican and Democratic administrations.

The most recent and perplexing lobbying effort caused Congress explicitly to prohibit Medicare from using its huge purchasing power to get lower prices for drugs, thus opening up a dollar pipeline, in the form of higher drug prices, directly from taxpayers to corporate coffers. These changes, along with the cave-in by the Food and Drug Administration (FDA) in 1997 that permitted direct-to-consumer advertising to bypass mention in their ads of all but the most serious side effects, have further augmented profits. The overall effect has been a corruption not only of science but also of the dissemination of science.

Angell documents that, contrary to what they claim, large pharmaceutical companies have "paltry output" in innovative research. In fact, as permitted by Bayh-Dole, pharmaceutical companies buy discoveries coming out of the basic-science enterprises, including universities and publicly funded granting agencies. The real costs of research on drugs by pharmaceutical companies are much less than the oft-quoted $800 million or so per new drug brought to market. Most of their research is on me-too drugs – unoriginal, tax-deductible (and thus paid for in lost taxes by the public), and mostly unnecessary. The Big Pharma companies are, in essence, manufacturing and marketing companies.

Angell's concluding chapter, the least convincing in an otherwise fascinating and penetrating book, contains the solutions, all of them predictable: control me-too drugs, re-empower the FDA, oversee Big Pharma's clinical research, curb patent length and abuse, keep Big Pharma out of medical education, make company financial statements transparent (so we can tell what the costs of research really are, as distinct from marketing), and impose price controls or guidelines. Granted, the problems are so prevalent and the corporate tentacles so entwined with our way of being that it is hard to see what else to recommend.

But perhaps Angell is right. We must change the way we manage research and the development and distribution of new drugs. Not only are health and health care at risk, but so are the research enterprise and the reputations of universities and governments. The integrity of scientific research is too important to be left to the invisible hand of the marketplace.

In the American mind, if Apple made weapons, they would undoubtedly be drones, those remotely piloted planes getting such great press here. They have generally been greeted as if they were the sleekest of iPhones armed with missiles.

When the first American drone assassins burst onto the global stage early in the last decade, they caught most of us by surprise, especially because they seemed to come out of nowhere or from some wild sci-fi novel. Ever since, they've been touted in the media as the shiniest presents under the American Christmas tree of war, the perfect weapons to solve our problems when it comes to evildoers lurking in the global badlands.

And can you blame Americans for their love affair with the drone? Who wouldn’t be wowed by the most technologically advanced, futuristic, no-pain-all-gain weapon around?

Here’s the thing, though: put drones in a more familiar context, skip the awestruck commentary, and they should have been eerily familiar. If, for instance, they were car factories, they would seem so much less exotic to us.

Think about it: What does a drone do? Like a modern car factory, it replaces a pilot, a skilled job that takes significant training, with robotics and a degraded version of the same job outsourced elsewhere. In this case, the “offshore” location that job headed for wasn’t China or Mexico, but a military base in the U.S., where a guy with a joystick, trained in a hurry and sitting at a computer monitor, is “piloting” that plane. And given our experience with the hemorrhaging of good jobs from the U.S., who will be surprised to discover that, in 2011, the U.S. Air Force was already training more drone “pilots” than actual fighter and bomber pilots combined?

NaturalNews) Mass vaccination is apparently not the only depopulation strategy being employed by the Bill & Melinda Gates Foundation, as new research funded by the organization has developed a way to deliberately destroy sperm using ultrasound technology.

BBC News reports that the Gates Foundation awarded a grant to researchers from the University of North Carolina (UNC) to develop this new method of contraception.

For their study, the UNC team tested ultrasound on lab rats and found that two 15-minute doses "significantly reduced" both sperm counts and sperm integrity. When administered two days apart through warm salt water, ultrasound caused the rats' sperm counts to drop below ten million sperm per milliliter, which is five million less than the "sub-fertile" range, and stay that way for up to six months.

The report claims the technology is for contraceptive purposes only and not for causing sterility. However, Dr. James Tsuruta, who led the research, told reporters that it is unclear whether or not the technology can cause long-term damage, and that more research is needed to determine whether or not repeated ultrasounds cause permanent damage.

The Gates Foundation awarded 78 different research projects with $100,000 grants each as part of its "Grand Challenges in Global Health Program." Ten of these projects specifically addressed new technologies for contraception, according to TIME, including one for a pill that inhibits the growth and maturation of sperm, and another for creating chemical compounds that prevent sperm from reaching the egg (http://healthland.time.com/2010/05/14/male-birth-control-stopping-sperm-with-ultrasound/).

"We think this could provide men with up to six months of reliable, low-cost, non-hormonal contraception from a single round of treatment," wrote the researchers in their report.

"Our long-term goal is to use ultrasound ... as an inexpensive, long-term, reversible male contraceptive suitable for use in developing to first world countries."

In American politics, it takes an enormous amount of money to win campaigns, and the rise of the “Super PACs” is allowing the wealthy to exert even more influence over the political process than they did before. When you examine the results of federal elections over the past several decades, you quickly discover that the candidate that raises the most money almost always wins. Wealthy individuals are limited by law as to how much money they can give directly to a political campaign, but there are no limits on how much money they can give to Super PACs. During the 2012 election season, some of these Super PACs actually have more money than the campaigns of the candidates that they support do. Buying the vote is not illegal in America, and these Super PACs are buying huge amounts of advertising in key states. Unfortunately, most Americans have never learned to think for themselves. Instead, they let the television do much of their thinking for them. If their trusted friend, the television, tells them to vote a certain way, then that is what they are likely to do. Super PACs are much more likely to run negative ads than the actual candidates are, and we have already seen very negative ads dramatically move the poll numbers in some of the states. Sadly, as long as very negative ads keep working people are going to keep using them.

Super PACs are supposed to be completely and totally “independent” of the campaigns that they support, but the reality is that many of these Super PACs are run and staffed by former top aides of the candidates.

Some of the candidates are relying on the Super PACs to be the “attack dogs” while they sit back and try to maintain a more “positive” image. If a Super PAC goes too far, a candidate can simply claim that he does not have any control over that Super PAC.

If money did not influence elections, then people would stop giving so much of it to the campaigns and to the Super PACs. The truth is that money does influence elections, and when wealthy individuals and big corporations are allowed to pour millions upon millions of dollars into these Super PACs it gives them a much, much larger say in the outcome of our elections than you and I have.

When you fall in love, it’s all about what you have in common, and you can hardly imagine that there are differences, let alone that you will quarrel over them, or weep about them, or be torn apart by them -- or if all goes well, struggle, learn, and bond more strongly because of, rather than despite, them. The Occupy movement had its glorious honeymoon when old and young, liberal and radical, comfortable and desperate, homeless and tenured all found that what they had in common was so compelling the differences hardly seemed to matter.

Until they did.

Revolutions are always like this: at first all men are brothers and anything is possible, and then, if you’re lucky, the romance of that heady moment ripens into a relationship, instead of a breakup, an abusive marriage, or a murder-suicide. Occupy had its golden age, when those who never before imagined living side-by-side with homeless people found themselves in adjoining tents in public squares.

All sorts of other equalizing forces were present, not least the police brutality that battered the privileged the way that inner-city kids are used to being battered all the time. Part of what we had in common was what we were against: the current economy and the principle of insatiable greed that made it run, as well as the emotional and economic privatization that accompanied it.

This is a system that damages people, and its devastation was on display as never before in the early months of Occupy and related phenomena like the “We are the 99%” website. When it was people facing foreclosure, or who’d lost their jobs, or were thrashing around under avalanches of college or medical debt, they weren’t hard to accept as us, and not them.

And then came the people who’d been damaged far more, the psychologically fragile, the marginal, and the homeless -- some of them endlessly needy and with a huge capacity for disruption. People who had come to fight the power found themselves staying on to figure out available mental-health resources, while others who had wanted to experience a democratic society on a grand scale found themselves trying to solve sanitation problems.

And then there was the violence.

My speculation is that, like WW II, when the bankers did this to Hitler, it is intended that the US establish and inculcate our zionist bankers into every place that has no Rothschild banking fiat bogus currency/credit system, and to confiscate all natural energy resources, land, soon gold and silver, and finally, water to exert complete control over the citizens of the globe. And all of this using War as the excuse and the military as the vehicle. Not to save the nation.... rather simply to guard the drug routes, assets of the corporations, and protect the elite. Finally to act as the military arm of the international corporations to assist and ensure their monopoly over all markets in their field of sales. Fascism at its finest and farthest ever traveled. This will then ensure a slave labor work force globally. It could not happen without first bringing down Europe and America.

How that will work, is the USA loses the war, but all the troops are in foreign countries and can't leave. So they will be integrated with the military remenants of the countries they are occupying. They will all be then placed under one global command. Since the USA no longer has any wealth creation going on, it can be used to police the world. Also Relocation as a tool of globalizing, along with permanent occupation by the US military on foreign soil. That is why Ron Paul could not be allowed to win this election. A dream for them, at best. Tyranny never has survived past the period of its inception. I truly believe that will be the case this time as well. Even if they depopulate the planet, it will only take about 15 million of us to bring them down. They can't change our DNA into ZOMBIES (remember, they use movies to tell us their plans) fast enough to prevent it. Then it will be their turn to "BE AFRAID".

With the United States now well into the second decade of what the Pentagon has styled an “era of persistent conflict,” the war formerly known as the global war on terrorism (unofficial acronym WFKATGWOT) appears increasingly fragmented and diffuse. Without achieving victory, yet unwilling to acknowledge failure, the United States military has withdrawn from Iraq. It is trying to leave Afghanistan, where events seem equally unlikely to yield a happy outcome.

Elsewhere -- in Pakistan, Libya, Yemen, and Somalia, for example -- U.S. forces are busily opening up new fronts. Published reports that the United States is establishing “a constellation of secret drone bases” in or near the Horn of Africa and the Arabian Peninsula suggest that the scope of operations will only widen further.

In a front-page story, the New York Times described plans for “thickening” the global presence of U.S. special operations forces. Rushed Navy plans to convert an aging amphibious landing ship into an “afloat forward staging base” -- a mobile launch platform for either commando raids or minesweeping operations in the Persian Gulf -- only reinforces the point.

Yet as some fronts close down and others open up, the war’s narrative has become increasingly difficult to discern. How much farther until we reach the WFKATGWOT’s equivalent of Berlin? What exactly is the WFKATGWOT’s equivalent of Berlin? In fact, is there a storyline here at all?

Viewed close-up, the “war” appears to have lost form and shape. Yet by taking a couple of steps back, important patterns begin to appear. What follows is a preliminary attempt to score the WFKATGWOT, dividing the conflict into a bout of three rounds. Although there may be several additional rounds still to come, here’s what we’ve suffered through thus far.

EXECUTIVE ORDER
NATIONAL DEFENSE RESOURCES PREPAREDNESS

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Defense Production Act of 1950, as amended (50 U.S.C. App. 2061 et seq.), and section 301 of title 3, United States Code, and as Commander in Chief of the Armed Forces of the United States, it is hereby ordered as follows:

PART I – PURPOSE, POLICY, AND IMPLEMENTATION

Section 101. Purpose. This order delegates authorities and addresses national defense resource policies and programs under the Defense Production Act of 1950, as amended (the “Act”).

Sec. 102. Policy. The United States must have an industrial and technological base capable of meeting national defense requirements and capable of contributing to the technological superiority of its national defense equipment in peacetime and in times of national emergency. The domestic industrial and technological base is the foundation for national defense preparedness. The authorities provided in the Act shall be used to strengthen this base and to ensure it is capable of responding to the national defense needs of the United States.

It's a curious and unfair system that homeowners face, with those in debt expected to meet the original terms of their mortgage loan even as we're seeing a cavalcade of misdeeds, shortcuts and in some cases outright fraud by their lenders. Nowhere is this pattern clearer than in Thursday's report from San Francisco auditors that 84 percent of foreclosures examined contained at least one violation of the law by the foreclosing party.

The report is only the latest in a series of incidents involving bad actors in the foreclosure crisis. Last year, I called for a moratorium on home foreclosures after Bank of America, JP Morgan Chase and Wells Fargo signed affidavits initiating foreclosure against borrowers without verifying the information they contained. In fact, problems have been so rampant that banks now require many buyers of foreclosed homes to sign contracts absolving the bank of liability should irregularities appear with the original foreclosure.

In light of these negligent practices, the $26 billion settlement last week between the U.S. Department of Justice, state attorneys general and the major banks raises as many questions as answers. For instance: If a house is illegally foreclosed upon and subsequently sold by the bank, who owns the home? The new buyer or the original owner? Untangling this mess might require new consumer protections, not just a payout from the banks accused of wrongdoing.
